Scrappy

Sorry to hear about your experience. I feel your pain. To be honest there is really not much that you can do to be compensated. You bought the car "as is", and from what I understand you don't have a written guarantee from the seller that the car is accident free. If the seller just gave you the standard verbal "I guarantee, bla, bla...", then you really don't have a guarantee at all. The only way you would get anything back from the seller, is if you can somehow convince him that it is in his best interest to compensate you for the expenses. Now, if the seller is a well known broker and wants to retain his good reputation then he may very well be negotiated with. But from what you are saying that doesn't seem to be the case. If you want to put any more pressure on the broker, you need to hire a lawyer to show that you are serious. However, that means more expenses out of your pocket, and unless you have any written proof of that the broker has broken any contract with you, you really don't have much to pressure the broker with.

You also mentioned that you got a Carfax report on the car. I went to check out the Carfax guarantee. Well, it is full of loopholes and really isn't much of a guarantee at all. In short they only guarantee to buy back the car if you find that there was a branded title on the car within a year of getting the Carfax (and registering the Carfax report with Carfax). But, just because your car was in an accident, doesn't mean that it will have a branded title.

In the end, I think you will just have to absorb the losses, and learn from the experience. The next time you buy a car "as is", get it inspected by someone you know will perform a very though inspection. Whenever you buy a car "as is", it is on you to confirm that the car meets your expectation. The seller is not giving any guarantees at all. It sounds like you have a good mechanic, and he will be a good resource to make sure you get a good car when buying your next car.

Again, sorry to hear about your experience.

Hakan
