Search and see if you can find my story on a claim where I insisted upon arbitration when the insurance co only allocated $3k for a destroyed 745. I had recently spent $12k on the car. The arbitration award was for $11k and the insuror refused to pay even though they agreed to arbitration. I took them to court and it cost them $59k including my attorney's fees, interest, etc (before the cost of their attorney). Best part -- I got to keep the damaged 745.

Sorry to see this Scottie. Car was hit in one of it's strongest corners,
the spare tire area.Check for spare wheel damage, jack etc.
here in Pa. maybe different in Calif. laws different but having been
hit myself several times here is my advice.
First off: responsibility for accident as reported by police at the scene.
Next you are owed a rental replacement car till yours is repaired. This
is provided by the "responsible" insured. Even if you have other cars, you
are due a replacement car till yours if fixed. This gives you negotiating
leverage till you sign repair agreement at the completion of repairs
to your standards.
